Artikel 1 – Definities

In deze Voorwaarden wordt verstaan onder:

Bedenktijd: de termijn waarbinnen de consument gebruik kan maken van zijn herroepingsrecht.

Consument: de natuurlijke persoon die niet handelt in de uitoefening van beroep of bedrijf en een overeenkomst op afstand aangaat met de ondernemer.

Dag: kalenderdag.

Herroepingsrecht: de mogelijkheid voor de consument om binnen de bedenktijd af te zien van de overeenkomst op afstand.

Ondernemer: de natuurlijke of rechtspersoon die producten en/of diensten op afstand aan consumenten aanbiedt.

Overeenkomst op afstand: een overeenkomst waarbij in het kader van een door de ondernemer georganiseerd systeem voor verkoop op afstand van producten en/of diensten, tot en met het sluiten van de overeenkomst, uitsluitend gebruik gemaakt wordt van één of meer technieken voor communicatie op afstand.

Techniek voor communicatie op afstand: middel dat kan worden gebruikt voor het sluiten van een overeenkomst, zonder dat consument en ondernemer gelijktijdig in dezelfde ruimte zijn samengekomen.

Algemene Voorwaarden: de onderhavige Algemene Voorwaarden van de ondernemer.

Artikel 3 - Toepasselijkheid

-Deze Algemene Voorwaarden zijn van toepassing op elk aanbod van, elke tot stand gekomen overeenkomst op afstand met- en alle bestellingen van de consument bij Artegia art & things.

-Door het plaatsen van een bestelling, verklaart de consument akkoord te gaan met deze algemene voorwaarden.

-Deze algemene voorwaarden zijn niet alleen van toepassing op alle artikelen die besteld zijn via  

technieken voor communicatie op afstand (zoals via onze webshop), maar eveneens op alle artikelen die worden aangeboden tijdens evenementen, markten en beurzen.     

-Voordat de overeenkomst op afstand wordt gesloten, worden deze algemene voorwaarden electronisch ter beschikking gesteld aan de consument. Als dit onmogelijk blijkt door onvoorziene omstandigheden, zullen de voorwaarden op verzoek van de consument kosteloos worden toegezonden.

-Situaties die niet in deze algemene voorwaarden zijn geregeld en/of onduidelijkheid over de uitleg en inhoud van onze voorwaarden, dienen te worden beoordeeld ‘naar de geest’ van deze algemene voorwaarden.

Artikel 4 – Ons aanbod

-Artegia art & things gebruikt afbeeldingen die een waarheidsgetrouwe weergave zijn van de aangeboden producten. Kennelijke vergissingen of kennelijke fouten in het aanbod binden de ondernemer niet.

-Om het voor de consument mogelijk te maken het aanbod goed te kunnen beoordelen, wordt bij de artikelen een volledige en nauwkeurige omschrijving van de aangeboden producten gegeven.  

-Over het algemeen zijn de producten die Artegia art & things aanbiedt uniek en vaak met de hand gemaakt. Daardoor kan het voorkomen dat er een klein verschil is tussen de getoonde afbeelding en de kleur, maat of vorm van het bestelde product. Dergelijke lichte afwijkingen zijn geen redenen voor schadevergoeding of beëindiging van de overeenkomst.

-Het aanbod is vrijblijvend en op basis van beschikbaarheid. De ondernemer heeft het recht om veranderingen aan te brengen of aanpassingen door te voeren in het assortiment. In dat geval zal Artegia de consument zo snel mogelijk informeren. (Op verzoek van de klant, zal Artegia zich inspannen om een vergelijkbaar product te leveren. Om een gewenst, alternatief product te kunnen leveren, kan het noodzakelijk zijn om de normale leveringstijd te overschrijden).

Artikel 5 – Overeenkomst

-De overeenkomst komt tot stand op het moment van aanvaarding door de consument van het aanbod en het voldoen aan de daarbij gestelde voorwaarden door de ondernemer.

-Indien de consument het aanbod langs elektronische weg heeft aanvaard, bevestigt de ondernemer onverwijld langs elektronische weg de ontvangst van de aanvaarding van het aanbod. Zolang de ontvangst van deze aanvaarding niet door de ondernemer is bevestigd, kan de consument de overeenkomst ontbinden.

-Indien de overeenkomst elektronisch tot stand komt, treft de ondernemer alle benodigde, technische maatregelen om de overdracht van data en elektronische betalingen te laten plaatsvinden in een  veilige webomgeving.

-De ondernemer kan zich - binnen wettelijke kaders - op de hoogte stellen of de consument aan zijn betalingsverplichtingen kan voldoen, evenals van die feiten en factoren die van belang zijn voor een verantwoord aangaan van de overeenkomst op afstand. Indien de ondernemer op basis van dit onderzoek goede gronden heeft om de overeenkomst niet aan te gaan, is hij gerechtigd gemotiveerd een bestelling te weigeren of aan de uitvoering bijzondere voorwaarden te verbinden.

Artikel 6 –Herroepingsrecht en kosten

-Bij de aankoop van producten heeft de consument gedurende 14 dagen de mogelijkheid de overeenkomst zonder opgave van redenen te ontbinden. Deze bedenktermijn gaat in op de dag na ontvangst van het product door de consument of een vooraf, door de consument aangewezen en aan de ondernemer bekend gemaakte vertegenwoordiger.

-Tijdens de bedenktijd zal de consument zorgvuldig omgaan met het product en de verpakking. Hij zal het product slechts in die mate uitpakken of gebruiken voor zover dat nodig is om te kunnen beoordelen of hij het product wenst te behouden. Indien hij van zijn herroepingsrecht gebruik maakt, zal hij het product met alle geleverde toebehoren en - indien redelijkerwijze mogelijk - in de originele staat en verpakking aan de ondernemer retourneren, conform de door de ondernemer verstrekte redelijke en duidelijke instructies.

-Wanneer de consument gebruik wenst te maken van zijn herroepingsrecht, is hij verplicht dit binnen 14 dagen na ontvangst van het product, elektronisch of schriftelijk kenbaar te maken aan de ondernemer. Nadat de consument kenbaar heeft gemaakt gebruik te willen maken van zijn herroepingsrecht, dient de klant het product binnen 14 dagen retour te sturen. De consument dient te bewijzen dat de geleverde zaken tijdig zijn teruggestuurd, door middel van een bewijs van verzending.

-Indien de klant na afloop van de in dit artikel genoemde termijnen, niet kenbaar heeft gemaakt gebruik te willen maken van zijn herroepingsrecht, resp. het product niet aan de ondernemer heeft teruggezonden, is de koop een feit.

Kosten bij herroeping:

-Indien een consument gebruik maakt van zijn recht op herroeping, komen ten hoogste de kosten van terugzending voor zijn rekening.

-Ongefrankeerde of onvoldoende gefrankeerde zendingen of zendingen onder rembours, worden niet geaccepteerd door Artegia.

-Indien de consument een bedrag betaald heeft, zal de ondernemer dit bedrag zo spoedig mogelijk, doch uiterlijk binnen 14 dagen na herroeping, terugbetalen. Voorwaarde hierbij is dat de webwinkelier het product reeds (terug) ontvangen heeft dan wel een sluitend bewijs van complete terugzending.

-Om er zeker van te zijn dat een correcte terugbetaling kan plaatsvinden, zal de consument Artegia per mail of andere technieken voor communicatie op afstand, informeren welke artikelen teruggestuurd worden, met vermelding van volledige naam, bestelnummer en bankrekening.

Artikel 7 - Prijzen

-Alle getoonde en genoemde prijzen zijn in euro’s (€) en inclusief BTW en verpakkingsmateriaal.

De kosten voor verzending zijn exclusief. 

-De getoonde prijzen zullen niet worden verhoogd zolang het aanbod geldt, tenzij hogere prijzen het gevolg zijn van verhoogde BTW tarieven.

-Alle prijzen zijn onder voorbehoud van druk – type - en zetfouten. Voor de gevolgen van druk – type- en zetfouten wordt geen aansprakelijkheid aanvaard. Bij druk – type - en zetfouten is de ondernemer niet verplicht het product volgens de foutieve prijs te leveren.

Artikel 8 - Bestelling, Levering en Verzending

-Bestellingen en levering:

-Ondanks ons goed uitgeruste voorraad beheer systeem, is het mogelijk dat een artikel is uitverkocht of tegelijkertijd besteld is door andere consumenten. In dat geval zal Artegia de consument zo snel mogelijk informeren wanneer het desbetreffende artikel weer voorradig is.

-Artegia zal zorgvuldig omgaan met alle geplaatste bestellingen en haar uiterste best doen om bestelde artikelen op tijd te leveren. Indien echter een besteld artikel om welke reden dan ook niet geleverd kan worden, zal Artegia de consument hiervan zo snel mogelijk op de hoogte stellen via email of andere technieken voor communicatie op afstand. De bestelling wordt dan geannuleerd. Het betaalde bedrag wordt zo snel mogelijk terugbetaald, niet later dan 14 dagen na de ontvangst van de desbetreffende email.  

-Het is ook mogelijk om bestelde artikelen af te halen. Dit kan echter alleen op afspraak.

In dat geval worden uiteraard geen verzendkosten in rekening gebracht.

Verzending:

-De verzendtijd van voorradige artikelen binnen Nederland bedraagt 5 – 7 dagen. Verzending naar andere landen gebeurt zo snel mogelijk en niet later dan 7 – 9 dagen, situaties van force majeure

uitgezonderd. Indien een verzending vertraagd is, niet of slechts gedeeltelijk mogelijk, zal de consument hiervan zo snel mogelijk na de datum van bestelling en niet later dan bovengenoemde tijden, door Artegia op de hoogte worden gesteld. In dat geval heeft de consument het recht om de bestelling kosteloos te annuleren. Artegia betaalt hiervoor echter geen schadevergoeding.      

-Artegia streeft ernaar om de hierboven genoemde verzendtijden aan te houden. Deze tijden kunnen echter niet worden gegarandeerd. Aan deze tijden kunnen geen rechten worden ontleend, noch zal er schadevergoeding worden betaald indien deze tijden worden overschreden.

-Het afleveradres is het adres dat de consument heeft verstrekt aan de ondernemer.

-Indien het onmogelijk blijkt om een bepaald product te leveren, zal de ondernemer zich inspannen om

een vervangend artikel aan te bieden, vergelijkbaar in type en kwaliteit. Artegia zal de consument op een duidelijke en begrijpelijke manier hierover informeren, niet later dan het moment van levering.

Indien een vervangend artikel wordt aangeboden, kan de consument altijd gebruik maken van het recht op herroeping. In dat geval komen de kosten van de retourzending voor rekening van de ondernemer.  

-Artegia spant zich in om de bestelde artikelen op een veilige manier te verpakken en gebruikt hiervoor passend verpakkingsmateriaal van degelijke kwaliteit. Schade of verlies dient door de consument onmiddellijk gemeld te worden aan MyParcel en Artegia, per email, andere technieken voor communicatie op afstand of schriftelijk, doch niet later dan 24 uur na ontvangst van de zending.

-Tot het moment van ontvangst door de consument of een door hem aan de ondernemer kenbaar gemaakte vertegenwoordiger, ligt het risico voor schade en/of verlies bij de ondernemer. 

-Onze producten worden vervoerd door: MyParcel (www.myparcel.nl).

-Indien een bestelling te groot of te kwetsbaar is voor normale verzending, zal Artegia in overleg met de consument beslissen om gebruik te maken van een passend alternatief voor verzending.

Artikel 9 - Betaling

Artegia art & things biedt de volgende betaalmogelijkheden aan:

Vooruitbetaling:

U kunt het bedrag zoals vermeld in de bevestiging van uw bestelling, inclusief de kosten van verzending, direct overmaken op IBAN nummer: NL43RABO162473117 op naam van

Artegia art & things (Rabobank, Den Haag).

Betaling via: 

- iDeal 

- Credit cards (Visa, Mastercard and American Express)

- Bancontant (België)

- Sofortbanking (Duitsland)

- PayPal 

Indien betalingen niet binnen 7 dagen geregistreerd zijn of ontvangen op de bankrekening van Artegia,wordt de bestelling automatisch geannuleerd.

Contante betaling:

Deze betaalmogelijkheid is alleen van toepassing indien bestelde artikelen persoonlijk worden afgehaald. Als u gebruik wilt maken van deze mogelijkheid, dient van te voren een afspraak te worden gemaakt op telefoonnummer: 31-6-51152727.

Verkoop tijdens evenementen, markten en beurzen:

Zowel contante betaling als pinbetalingen met Europese bankpassen worden geaccepteerd.

Artikel 10 - Klachten en Service

-Artegia art & things streeft naar tevreden klanten door het aanbieden van goede service en een klantvriendelijke houding. Indien u een klacht heeft, zullen wij ons inspannen om die in redelijkheid op te lossen in overleg met onze klanten.

-Als u vragen, klachten of suggesties heeft, stelt Artegia het op prijs als u ons dat laat weten door het versturen van een email naar: info@artegia.nl

-Om een goede klachtafhandeling door Artegia te waarborgen, dienen de volgende procedures gevolgd te worden. Klachten over de uitvoering van de overeenkomst moeten binnen 7 dagen nadat een gebrek is geconstateerd of onvoldoende service is verleend, worden gemeld aan de ondernemer met een duidelijke en volledige omschrijving van de feiten. 

-Klachten aan de ondernemer zullen binnen 14 dagen na ontvangst worden beantwoord. Indien verder onderzoek nodig is, zal Artegia de ontvangst bevestigen en de consument informeren wanneer een meer gedetailleerd antwoord verwacht kan worden.

-Het indienen van een klacht heeft geen invloed op de verantwoordelijkheid van Artegia tenzij de ondernemer schriftelijk anders aangeeft.

-Indien een klacht gegrond is volgens de ondernemer, zal Artegia het geleverde artikel repareren of vervangen, naar gelang de voorkeur van de consument.

-Indien een klacht niet kan worden opgelost in onderling overleg, ontstaat een geschil dat voorgelegd kan worden aan een Geschillencommissie.

Artikel 11 – Geschillen

-Bij klachten dient een consument zich allereerst te wenden tot de ondernemer. Bij klachten die niet in onderling overleg opgelost kunnen worden, dient de consument zich te wenden tot Stichting WebwinkelKeur (www.webwinkelkeur.nl), deze zal gratis bemiddelen.

 -Indien deze bemiddeling niet leidt tot een oplossing, heeft de consument de mogelijkheid om zijn klacht te laten behandelen door de, door Stichting WebwinkelKeur aangestelde onafhankelijke geschillencommissie. De uitspraak hiervan is bindend en zowel ondernemer als consument stemmen in met deze bindende uitspraak.

- Aan het voorleggen van een geschil aan deze Geschillencommissie zijn kosten verbonden die door de consument betaald dienen te worden aan de betreffende commissie. Tevens is het mogelijk om klachten aan te melden via het Europees ODR platform (http://ec.europa.eu/odr).

-Op overeenkomsten tussen de ondernemer en de consument waarop deze algemene voorwaarden betrekking hebben, is uitsluitend Nederlands recht van toepassing. Ook indien de consument verblijft of woonachtig is in het buitenland. Het Weens Koopverdrag is niet van toepassing.

Artikel 12 – Beperking van aansprakelijkheid

-Artegia art & things kan niet aansprakelijk worden gesteld voor situaties van force majeure. Dit is bijvoorbeeld, maar niet uitsluitend, vertraging bij verzending, storingen van het Internet of schade veroorzaakt door een artikel dat in goede staat is geleverd. 

-De maximale aansprakelijkheid van Artegia zal niet hoger zijn dan het bedrag van de factuur van de bestelling, met aftrek van de verzendkosten.

Artikel 13 - Privacy beleid

-Wij respecteren uw privacy en het vertrouwen dat u in ons stelt.

-Om u een goede en persoonlijke service te kunnen bieden en uw bestelling snel en efficiënt

te kunnen verwerken, vraagt Artegia art & things u om een aantal persoonlijke gegevens.

-Deze persoonlijke gegevens zijn alleen voor eigen gebruik van Artegia en zullen daarom met zorg en vertrouwelijkheid worden gebruikt in een veilige internet omgeving.

-Uw persoonsgegevens zullen niet ter beschikking worden gesteld aan derden, tenzij u daar uitdrukkelijk toestemming voor heeft gegeven.

-Om een beter inzicht te krijgen in onze klanten en onze diensten hierop kunnen afstemmen, maakt de website van Artegia art & things gebruik van Cookies. 

-Door het gebruik van onze website, geeft u aan ons Privacy beleid te accepteren.

Artikel 14 – Eigendomsrecht

-Door gebruik te maken van deze website geeft u aan te accepteren dat alle Inhoud beschermd is door eigendomsrecht en recht van intellectueel eigendom. Niets van deze website (inclusief beeld- en foto materiaal, logo’s, teksten e.a.) mag daarom gecopieerd of verspreid worden in enige vorm, via enig medium of andere, huidige of toekomstige technologische middelen, zonder schriftelijke toestemming vooraf van Artegia art & things.

Artikel 15 – Aanvullende of afwijkende bepalingen

Aanvullende bepalingen dan wel bepalingen die afwijken van deze algemene voorwaarden, mogen niet ten nadele van de consument zijn en dienen schriftelijk te worden vastgelegd op een zodanig toegankelijke manier, dat de consument deze makkelijk kan opslaan op een duurzame gegevensdrager.

Article 1 – Definitions

The following definitions apply to these Conditions/Terms:

Time for consideration: the time during which a consumer can exercise the right of withdrawal.

Consumer: the natural person not dealing on behalf of a company or profession who

enters into a distance agreement with the entrepreneur.

Day: calendar day

Right of Withdrawal: the possibility for the consumer to terminate the distance agreement

within the time for consideration.

Entrepreneur: the natural person or corporation who offers distance products to consumers.

Distance Agreement: an agreement based on a corporate organized system of distance

sales of products and services including the concluding of an agreement using one or more

techniques of distant communication.

Technique of distant Communication: a means that can be used to conclude an agreement

without the consumer and the entrepreneur having gathered in the same place and at

the same time.

General Conditions: the current General Conditions of the entrepreneur.

Article 3 – Applicability

-These Conditions are applicable to all offers made by and agreements concluded with

 Artegia art & things.

-By placing an order, the consumer agrees to accept these general conditions.

-These general conditions do not solely apply to all articles ordered via techniques of distance communication (such as our webshop), but are applicable as well to all articles offered and sold during Events, Fairs and Tradeshows.

-Before the distance agreement is concluded, the text of these general conditions will be made available to the consumer electronically. Should this not be possible due to unforeseen circumstances, on request of the consumer these conditions will be forwarded free of charge

-Situations not covered by these general conditions and uncertainty in interpretation of one or more of our provisions, are to be explained “in the spirit” of these conditions.

Article 4 – Our offers

-Artegia art & things uses the most truthful images possible to show the offered products. Obvious errors or mistakes in the offer are not binding for the entrepreneur.

-Our offers include a sufficiently detailed and complete description of the available products for the consumer to make a valid judgement of the articles shown.

-Generally products offered by Artegia art & things are unique and mostly handmade. Consequently, they can vary slightly in colour, size or shape from the images shown. Deviations can therefore not be a reason for compensation or termination of the agreement.

-The offer is subject to availability. The entrepreneur has the right to make changes and adjustments to the offers. In this event Artegia will inform the consumer as soon as possible. (On request of the customer, Artegia can make an effort to provide a similar product. The normal time of delivery will then be extended to a period of time necessary to acquire the desired product). 

Article 5 - Agreement   

-The agreement is concluded from the time the consumer has accepted the offer in accordance with the conditions of the entrepreneur.-If the consumer has accepted the offer electronically or through other techniques for distance communication, the entrepreneur will immediately confirm the receipt of acceptance of the offer by the same means. As long as the entrepreneur has not confirmed the acceptance, the consumer can cancel the agreement.  

-If the agreement is made electronically, the entrepreneur will take all required, technical measures to ensure a safe web environment for the transfer of data and electronic payments.

-Within the applicable law-, The entrepreneur can avail himself of information to assess if a consumer is able to meet the payment obligation and of facts and factors which can be relevant to enter responsibly into a distance agreement. If the entrepreneur, on basis of such information, finds valid grounds not to enter into an agreement, he/she has the right to refuse an order, provided the refusal is motivated, or add special conditions.

Article 6 –Right of withdrawal and costs

-When purchasing a product, a consumer has the possibility to cancel the agreement without giving any reasons for 14 days. This time for consideration starts on the day after receipt of the product by the consumer or a representative appointed in advance and made known to the entrepreneur.   

-During the time of consideration the consumer will carefully handle both product and packaging. The consumer will only unwrap the packaging or use the product in as far as this is necessary to establish whether or not he/she wishes to keep the product. If the consumer wishes to exercise his/her right of withdrawal,  -if reasonably possible- the product should be returned to the entrepreneur in its original state and packaging, in accordance with reasonable and clear instructions given by the entrepreneur.

-If  the consumer wishes to exercise the right of withdrawal, he/she is obliged to make this known to the entrepreneur within 14 days after receiving the product, by techniques for distance communication or in writing. After having made known to the entrepreneur the product will be returned, the consumer has 14 days to return the product. The consumer needs to prove the delivered articles have been returned in time, by providing the receipt for the shipment.

-If a consumer fails to inform the entrepreneur of his wish to exercise the right of withdrawal and/or fails to return the product to the entrepreneur within the time limitations above, the purchase has been made.   

-Costs of withdrawal:

-If a consumer exercises his/her right of withdrawal, the costs will be limited to the payment of the return shipment, which are paid by the consumer. 

-Unstamped shipments, insufficiently stamped shipments or cash-on-delivery parcels (rembours),

will not be accepted by Artegia.

-If the consumer has paid an amount, the entrepreneur will return the amount paid as soon as possible, but no later than 14 days after the withdrawal. Payment will only be made after the entrepreneur has received the returned product, or definite proof of complete return shipment. 

-To ensure correct reimbursement by Artegia, the consumer will inform the entrepreneur by email or other techniques for distance communication, which articles are returned, using full name, order number and bank account.

Article 7 – Prices

-All shown and mentioned prices are in euro’s (€’), VAT and packaging included.

Costs of shipping are excluded.

-Prices shown will not be raised as long as the offer is valid unless higher prices are the consequences of raised VAT tariffs.    

-Artegia art & things does not accept any liability for the consequences of typographical and/or printing errors in prices. In the event of typographical and/or printing errors, the entrepreneur is not obliged to deliver a product for the incorrect price indicated.

Article 8 – Orders, Delivery and Shipment

-Orders and Delivery:

Although Artegia maintains a proper system for stock management, it is possible an article is sold out or has been ordered simultaneously by other consumers. In such an event Artegia will inform the consumer as soon as possible when the article concerned will be available again.    

-Artegia will carefully manage all orders placed and do its utmost to deliver them in time. If however, for any reason, an ordered article can not be delivered, Artegia will inform the consumer as soon as possible by email or other techniques for distance communication. The order is then cancelled. The amount paid will be returned not later than 14 days after receipt of the email.    

-Ordered articles may also be collected in person, however, by appointment only.

In that event no shipping costs will be charged.

Shipment:

-For items in stock, delivery times within The Netherlands, are 5-7 days. Shipments to other countries will be made as soon as possible and no later than 7-9 days, unless a situation of force majeure occurs. If a delivery is delayed, not or only partly possible, the consumer will be informed as soon as possible after the date of the order but not later than the times mentioned in this paragraph. In that event the consumer has the right to cancel the order free of charge. However, compensation will not be provided.

-The afore mentioned delivery times are the times Artegia strives at but they can not be guaranteed. No rights can be derived from these times nor will compensation be offered if these times are exceeded.

-The location of delivery will be the address made known to the entrepreneur by the consumer.

-In the event delivery of an ordered product proves not to be possible, the entrepreneur will do the utmost to offer a replacement of similar type and quality. Artegia will inform the consumer in a clear and understandable manner of such a replacement at the latest, at the time of delivery. When replacement articles are delivered, the consumer can at all times exercise the right of withdrawal. In this situation the costs of the return shipment will be paid by the entrepreneur.

 -Artegia makes every effort to ensure safe packaging by using proper and suitable package materials.  Damage or loss needs to be reported by email,other techniques for distance communication or in writing immediately, but not later than 24 hours after the receipt of the package, to both MyParcel and Artegia.

-Until the moment of delivery to the consumer or an appointed representative made known to the entrepreneur in advance, the risk of damage and/or loss of products is borne by the entrepreneur.

-Our products are shipped with: MyParcel (www.myparcel.nl).

-In the event the size of an order is too large or too vulnerable for regular shipping, Artegia will decide, together with the consumer, on a suitable alternative for its shipment.

Article 9 – Payment

Artegia art & things offers several methods of payment:

Payment in advance:

You can transfer the amount as specified in the confirmation of your order, including the costs for shipment, directly to the IBAN number: NL43RABO162473117 in the name of Artegia art & things (Rabobank, The Hague, The Netherlands).

Payment through:

- iDeal 

- credit cards (Visa, Mastercard and American Express)

- Bancontant (Belgium)

- Sofortbanking (Germany)

- PayPal 

If payments have not been registered or received in the bank account of Artegia within 7 days,

the order will be cancelled automatically.

Cash payment:

This method of payment can only be used if an order is collected in person. If this option is chosen, an appointment needs to be made in advance at telephone number: 31-6-51152727.

Sales at markets, fairs and tradeshows:

Both cash and electronic payments by European bankcards are accepted.   

Article 10 – Complaints and Service

-Artegia art & things aims at satisfied customers by offering good services and a consumer friendly attitude. In the event of complaints, we will make every effort to solve these in reasonability and in concert with our customers.

-If you have any questions, complaints or suggestions, Artegia appreciates it you let us know by forwarding an email to info@artegia.nl

-In order to ensure proper complaint handling by the entrepreneur, the procedures below should be followed. Complaints about the execution of the agreement need to be submitted to Artegia within 7 days after a defect has been observed or a lack of service occurred, with a full and clear description of the facts. 

-Complaints submitted to the entrepreneur will be answered within 14 days from the date of receipt.

If more time is needed to make further inquiries, Artegia will acknowledge receipt and inform the consumer when a more detailed reply may be expected.

-Filing a complaint does not alter the responsibility of Artegia unless the entrepreneur indicates otherwise in writing.

-If the entrepreneur finds the complaint is well-founded, Artegia will arrange for repair or replace the delivered article, as preferred by the consumer.

-If a complaint can not be resolved in mutual agreement, a dispute arises which may be submitted to an arbitration committee.

Article 11 - Disputes

-In the event of a complaint, a consumer first needs to address the entrepreneur. If a complaint can not be resolved in mutual agreement, the consumer has the possibility to turn to Stichting WebwinkelKeur (www.webwinkelkeur.nl), a Dutch Foundation which will mediate free of charge.

-If the afore mentioned mediation has not resulted in an adequate solution, the consumer has the possibility to submit the complaint to the independant Arbitration Committee appointed by the Stichting WebwinkelKeur. The ruling of this committee is binding and will be accepted by both consumer and entrepreneur.

-If a dispute is submitted to this Arbitration Committee, costs will be incurred which are to be paid by the consumer to this committee directly. It is also possible to submit a complaint via the European ODR platform, Online Dispute Resolution (http://ec.europa.eu/odr).

-All agreemens between Artegia art & things and the consumer are concluded on basis of our General Conditions and are subject to Dutch Law, also if the consumer resides or lives in another country.

The Vienna Sales Convention,(CISG, Convention on the International Sales of Goods),

shall not apply.

Article 12 - Limitation of Liability

-Artegia art & things can not be held liable for situations of force majeure. These may be but not exclusively, delays in shipment, disruptions to the Internet or damage that may have been caused by an article delivered in good condition.

The maximum liablity of Artegia will not exceed the amount of the billing for the order concerned minus cost of shipping.

The following definitions apply to these Conditions/Terms:
Time for consideration: the time during which a consumer can exercise the right of withdrawal.
Consumer: the natural person not dealing on behalf of a company or profession who enters into a distance agreement with the entrepreneur.

Right of Withdrawal: the possibility for the consumer to terminate the distance agreement within the time for consideration.

Article 3 – Applicability

-These Conditions are applicable to all offers made by and agreements concluded with Artegia art & things.
-By placing an order, the consumer agrees to accept these general conditions.
-These general conditions do not solely apply to all articles ordered via techniques of distance communication (such as our webshop), but are applicable as well to all articles offered and sold during Events, Fairs and Tradeshows.
-Before the distance agreement is concluded, the text of these general conditions will be made available to the consumer electronically. Should this not be possible due to unforeseen circumstamces, on request of the consumer these conditions will be forwarded free of charge.
-Situations not covered by these general conditions and uncertainty in interpretation of one or more of our provisions, are to be explained “in the spirit” of these conditions.

Article 4 – Our offers

-Artegia art & things uses the most truthful images possible to show the offered products. Obvious errors or mistakes in the offer are not binding for the entrepreneur.
-Our offers include a sufficiently detailed and complete description of the available products for the consumer to make a valid judgement of the articles shown.
-Generally products offered by Artegia art & things are unique and mostly handmade. Consequently, they can vary in colour, size or shape from the images shown. Deviations can therefore not be a reason for compensation or termination of the agreement.
-The offer is subject to availability. The entrepreneur has the right to make changes and adjustments to the offers. In this event Artegia will inform the consumer as soon as possible. (On request of the customer, Artegia can make an effort to provide a similar product. The normal time of delivery will then be extended to a period of time necessary to acquire the desired product).

Article 5 - Agreement

-The agreement is concluded from the time the consumer has accepted the offer in accordance with the conditions of the entrepreneur.
-If the consumer has accepted the offer electronically or through other techniques of distance communication, the entrepreneur will immediately confirm the receipt of acceptance of the offer by the same means. As long as the entrepreneur has not confirmed the acceptance, the consumer can cancel the agreement.
-If the agreement is made electronically, the entrepreneur will take all required, technical measures to ensure a safe web environment for the transfer of data and electronical payments.
-Within the applicable law-, The entrepreneur can avail himself of information to assess if a consumer is able to meet the payment obligation and of facts and factors which can be relevant to enter into a distance agreement. If the entrepreneur, on basis of such information, finds valid grounds not to enter into an agreement, he/she has the right to refuse an order or add special conditions.

Article 6 –Right and costs of withdrawal

-When purchasing a product, a consumer has the possibility to cancel the agreement without giving any reasons for 14 days. This time for consideration starts on the day after receipt of the product by the consumer or a representative appointed in advance and made known to the entrepreneur.
-During the time of consideration the consumer will carefully handle both product and packaging. The consumer will only unwrap the packaging or use the product in as far as this is necessary to establish whether or not he/she wishes to keep the product. If the consumer wishes to exercise his/her right of withdrawal, -if reasonably possible- the product should be returned to the entrepreneur in its original state and packaging, in accordance with reasonable instructions given by the entrepreneur.
-If the consumer wishes to exercise the right of withdrawal, he/she is obliged to make this known to the entrepreneur within 14 days after receiving the product, by techniques of distance communication or in writing. After having made known to the entrepreneur the product will be returned, the consumer has 14 days to return the product. The consumer needs to prove the delivered articles have been returned in time, by providing the receipt for the shipment.
-If a consumer fails to inform the entrepreneur of his wish to exercise the right of withdrawal and/or fails to return the product to the entrepreneur within the time limitations above, the purchase has been made.

-Costs of withdrawal:
If a consumer exercises his/her right of withdrawal, the costs will be limited to the payment of the return shipment, which are paid by the consumer.
-Unstamped shipments, insufficiently stamped shipments or cash-on-delivery parcels (rembours), will not be accepted by Artegia.
-If the consumer has paid an amount, the entrepreneur will return the amount paid as soon as possible, but no later than 14 days after the withdrawal. Payment will only be made after the entrepreneur has received the returned product, or definite proof of complete return shipment.
-To ensure correct reimbursement by Artegia, the consumer will inform the entrepreneur by email or other techniques of distance communication, which articles are returned, using full name, order number and bank account

Article 7 – Prices

-All shown and mentioned prices are in euro’s (€’), VAT and packaging included. Costs of shipping are excluded.
-Prices shown will not be raised as long as the offer is valid unless higher prices are the consequences of raised VAT tariffs.
-Artegia art & things does not accept any liability for the consequences of typographical and/or printing errors in prices. In the event of typographical and/or printing errors, the entrepreneur is not obliged to deliver a product for the incorrect price indicated.
